Statutory Motion
 

                                                              

 


 

Thefollowing Motion given notice of by Shri Sitaram Yechury, M.P. and ShriRitabrata Banerjee, M.P., has been admitted:-

 

“That this Houseresolves in pursuance of Section 28 of the University Grants Commission Act,1956, the University Grants Commission (Minimum Standards and Procedure forAward of M. Phil/Ph.D. Degrees) Regulations, 2016 published in the Gazette ofIndia dated 5th July, 2016 vide Notification No.F.1-2/2009(EC/PS) V(I).Vol.II and laid on theTable of the House on the 11th August, 2016, be modified as follows:-

1.     That in regulation 1.2 atpage 7, after the word “under Section 3 of UGC Act, 1956”, the words “inharmony with the law on reservation and adopted in accordance with the relevantUniversity’s Act. Provided that nothing in this regulation will contravene theCentral Educational Institutions Act (Reservation in Admissions) Act, 2006,where applicable, nor will any such amendment be applied with retrospectiveeffect.”be added;

2.     Thatin regulation 5.2.1 at page 8,line 2, afterthe word “admitted” insert “inaccordance with the Universities Act”;

 

3.     Thatin regulation 5.2.1 at page 8, at line 3, substitutethe word “available” with “sanctionedfaculty strength”

 

  1. That in regulation 5.2.1 at page 8, delete the following “'keeping in mind the norms regarding thescholar teacher ratio (as indicated in Para 6.5) laboratory, library and suchother facilities”;

 

5.     That in the regulation5.2.3 at page 8 after the word “adhere to the national/State-level reservationpolicy, as applicable” insert thefollowing “Provided that nothing inthis regulation will contravene the Central Educational Institutions Act(Reservation in Admissions) Act, 2006”;

6.     That in regulation 5.3 at page 8, after thewords “statutory bodies concerned” the words “in accordance with the Act of theconcerned University” be inserted;

  1. That in regulation 5.3, at page 8, at the end insert the following “Provided that nothing in this regulation willcontravene the Central Educational Institutions Act (Reservation in Admissions)Act, 2006 where applicable, nor will any such amendment be applied withretrospective effect”;

     

  2. That in regulation 5.4.1at page 8, substitute the following“'with qualifying marks as 50%. The syllabus of the Entrance Test shall consistof 50% of research methodology and 50% shall be subject specific” with “and shall test research aptitudeand subject knowledge. The weightage of written examination to viva voce shallbe determined in accordance with the Acts and statutes of the concerneduniversity and law of the land”

 

  1. That after regulation 5.4.2, at page 9, insert the following

“5.4.3Relevant statutory bodies of the concerned university shall adopt a criterionof reasonableness and non-arbitrariness to determine the relative weightage ofwritten entrance exam and interview/viva voce.

5.4.4 The combined aggregate marks scored bythe candidate in the written entrance exam and the interview will determine themerit list for admission to the programme. Reservation will be applied at eachstage of the admission”

 

10.  That in regulation 6.1, at page 9, at lines 2, 4 and 5, delete the word “referred”.

 

11.  Substitute regulation6.5, at page 9, with the following:

"A Research Supervisor/Co-supervisor,at any given point of time, may supervise a minimum of one and a maximum ofthree M. Phil; and, a minimum of six and a maximum of twelve Ph.D. Scholars,adopted in accordance with the concerned University's Act. Provided thatnothing in this regulation will contravene the Central Educational Institutions Act (Reservation in Admissions) Act,2006, where applicable, nor will any such amendment be applied withretrospective effect."

 And

That this House recommends to Lok Sabha that Lok Sabha do concur inthis Motion”
