RE. CONVERSION OF PRIVILEGE NOTICES INTO DISCUSSION UNDER RULE 176 ON INDO-US CIVIL NUCLEAR CO-OPERATION AGREEMENT

YMR. CHAIRMAN: The Chair has to give a ruling on notices given under Rule 168. I have received several notices under Rule 168 on matters pertaining to the Indo-US Nuclear Agreement. On scrutiny of these notices, I have found that in some of the motions, a demand has been made for disapproval or rejection of the Agreement or have a vote of the House on it. In other cases, a demand has been made for re-negotiation of the Agreement. There are other notices of motion, again under Rule 168, in which a demand has been made to have a discussion on the Agreement. Since it is not a Constitutional obligation for the Executive to have the approval of Parliament on any international treaty or agreement, admission of these motions which involve approval of Parliament would not be in order. I am, therefore, converting these notices into notices for discussion under Rule 176. The Business Advisory Committee has already identified this subject for discussion.

MR. CHAIRMAN: A number of matters have been mentioned to be raised with the permission of the Chair. Shri Jaswant Singh, the Leader of the Opposition.

MATTER RAISED WITH PERMISSION OF CHAIR

RE. INDO-US CIVIL NUCLEAR CO-OPERATION AGREEMENT

THE LEADER OF THE OPPOSITION (SHRI JASWANT SINGH): Mr. Chairman, Sir, I have been endeavouring to raise this issue for several days and, for one reason or another, I was not able to do so. I do not wish to revisit that rather unpleasant chapter as to why I was prevented from saying what I wish to share with the House. I refer here, Sir, to the Chair, who is also good enough just now to give a ruling on how the discussion, when it takes place, on the Indo-US Nuclear Agreement is to be done. Now this Agreement has become an issue really of mounting concern and it is a matter that has turned extremely curious. (Interruptions)

SHRI PRAVEEN RASHTRAPAL: Sir, are we discussing Nuclear Deal? (Interruptions) Sir, are we discussing Nuclear Deal? (Interruptions)

MR. CHAIRMAN: Please allow the hon. Member to proceed. (Interruptions) Please allow the hon. Leader of the Opposition to proceed. (Interruptions) The Chair has given a ruling on matters to be raised with the permission of the Chair. There are other matters also to be raised. Please allow the hon. Member to proceed, so that others can also proceed. (Interruptions) The agreed procedure for this is that Members are given the floor to have their say for three minutes. I would request you to allow the hon. Member to proceed. (Interruptions) You must let him proceed. (Interruptions) Please go ahead, Sir. (Interruptions)

SHRI JASWANT SINGH: Sir, it is my experience that the level of noise is in inverse proportion to the content of reason when such interruptions take place. Every hon. Member should permit me to say what I have to say. I am sure they themselves would share the concerns of the House and I did say that it's a very curious situation that has developed because national security, national interests, and the future of the country -- next half century or so -- are affected.

MR. CHAIRMAN: Please sit down. Let the hon. Leader of Opposition proceed. (Interruptions)

SHRI JASWANT SINGH: Sir, the hon. Members had some very serious grievances when I uttered the words "the hon. the Prime Minister". On the 13th of this month, he made a statement which clarified, according to him, the Government's position which was refuted the very next day by certain spokesman of the State Department of the United States Government and altered yet again the next day. I think that has led to the moving of Motion of Privilege by certain hon. Members. That's a different matter. Sir, in between, the hon. the Prime Minister had found fit to let the country know -- and I wonder why he said it -- that those who oppose this agreement are, I am sorry to use the word, * .
