MR. DEPUTY CHAIRMAN: What I feel is that this is a recommendation which has come from the U.P. Government. The hon. Minister has explained the procedure for including the castes. The procedure is, the recommendation should come from the State Government. Now, instead of protesting against this issue here, you raise a protest against it in the U.P. Assembly.

SHRIMATI BRINDA KARAT: Sir, I want to raise a small point. Sir, I fully appreciate what you have said, and what the hon. Minister has explained that there is a set procedure. My point is, there is also a set procedure in parliamentary proceedings in which the issues of the Scheduled Castes and Scheduled Tribes are raised in this House because they have national implications to the Constitution. Now, if there is such an issue which has come, I have raised a very legitimate problem of the Namosudras, the Minister has replied to it. Then she has also gone further to list out a whole list of castes who are not going to be included in Uttar Pradesh, whereas, they are in other States. Therefore, there is a contradiction here in the functioning of the constitutional provisions for affirmative action for those who belong to the Scheduled Caste. Therefore, I am requesting you, Sir, to kindly allot some time for a separate discussion.

It is stated: "The proposed amendments in the Constitution (Scheduled Castes) Order (Amendment) Bill, 2006 broadly fall under the following categories, namely, inclusion of new castes based on social, educational and economic backwardness." Sir, in respect of Scheduled Castes, this term 'economic backwardness' has not been there in the Constitution. It is, I think, strictly put in to create so much unrest. I request that that should not form part of the Bill.
