SHRIMATI HEMA MALINI (NOMINATED): Mr. Vice-Chairman, Sir, I congratulate the hon. Minister for bringing forward this Bill. I welcome this Bill. The Indian women's movement started with addressing the problems that women faced, like violence, property rights, legal status, political participation and the rights of minority women. Today, Indian women have made several victories against an oppressive way of life and are poised to raise pertinent questions that will make their lives more emancipating. Poverty, early marriage, malnutrition and lack of health care during pregnancy are the major reasons for both maternal and infant mortality. In rural India, almost 60 per cent of the girls are married before they are eighteen. Nearly 60 per cent of married girls bear children before they are nineteen. Almost one-third of all the babies are born with low birthweight. Maternal mortality in India is the second highest in the world, estimated to be from 385 to 487 per 1000 live births. Close to 125,000 women die, each year, from pregnancy and pregnancy-related causes. General meaning of child marriage is marriage of individuals before they attain the age of adulthood. The Child Marriage Restraint Act, 1929, defines child marriage as a marriage to which either of the contracting party is a child. Child marriage is widespread in some parts of India and systematically engraves the exploitation and subjugation in society. Many communities in many States have their deep-rooted faith in perpetuation of this practice, and there is considerable evidence that they are not ready to eradicate this practice. Various researches and studies conducted to assess the devastating effect of child marriage have thrown sufficient light on how child marriages virtually contribute to every social problem that affects women. Early marriage also has implications for the well-being of families, and for societies as well, as a whole, where girls are uneducated and unprepared for their roles as mothers and contributors to society. There are costs to be borne at every level, from the individual household to the nation as a whole. Unfortunate aspect of child marriage is that some are forced into marriage at a very early age. Others are simply too young to make an informed decision about their marriage partner or about the implications of marriage itself. In a child marriage, the individuals involved are not physically, mentally and emotionally ready to perform the obligations that are expected of them. The general insecurity that prevailed, especially, with regard to women, made the presence of young and unmarried girls a potential disaster. The practice of child marriage reached its heights so that guardians could get rid of this insecurity as soon as possible. Hence, parents sought to dispense with the responsibility of their daughters by getting them married before they reach the marriageable age. The customs of child marriage with bride and groom still in their cradles was a culmination of this intention. In addition, it was also felt that this would reduce the danger to growing girls' virginity. There has been a wide range of criticism in and outside Parliament that even though nearly 75 years have passed since the enactment of the Child Marriage Restraint Act, 1929, yet it could not eradicate, or, effectively prevent the evil practice of solemnisation of child marriages in the country. The Act aims at only restraining solemnisation of child marriage and not complete prevention. Women continue to be the unfortunate target of malpractices and one of which that needs to be looked into is trafficking. The extent of trafficking in women is unknown. However, one official study admits to 1,00,000 prostitutes in six metro cities. Of these, 15 per cent are girls below the age of fifteen. (Contd. by 2Q/SKC)

SHRIMATI HEMA MALINI (CONTD.): Cross-border trafficking is common. Something has to be done to protect these women who are often forced into prostitution. Atrocities against women in India are on an alarming rise. A recent study showed that every 26 minutes a woman is molested, every 34 minutes a rape takes place, every 42 minutes an incident of sexual harassment occurs, every 43 minutes a woman is kidnapped and every 93 minutes a woman is burnt to death over dowry. One quarter of the reported rapes involve girls under the age of 16 years. However, unfortunately, vast majority of the cases are never reported.

Recent movies like 'Water' deal with the need for eradication of our old customs that are a hindrance to the growth and development of women. 'Water' deals with the problem of a child bride forced into marriage with an old man, who then becomes a widow even before she can understand the meaning of marriage; she is made to wear a widow's garb and then forced into prostitution.

Social awareness is what we must focus on in order to do away with malpractices like child marriage, child labour, dowry harassment, domestic violence and trafficking, all of which are prevalent to this day. Just passing a Bill or enacting a law is not really going to control all this. The need of the hour is for the Government to take stringent action against the law-breakers, so that this practice dies its natural death. I would request the hon. Minister to see to it that the law-breakers are suitably punished, as only this kind of a follow up action can give direction to the law.
