ָ ֟ ֯ 3(2) , it is stated in clause 3(2) that, "If at the time of filing a petition, the petitioner is a minor, the petition may be filed through his or her guardian or next friend along with the Child Marriage Prevention Officer". I fail to understand the meaning of it. What is meant by "along with"? It means that I can make an interpretation in the court by saying that the petitioner is a minor and, therefore, the petition can be filed through his or her guardian or next friend and, apart from these two options, the Child Marriage Prevention Officer also.

Then, you have conferred the powers on the District Judge who will declare a decree of nullity. No doubt about it. But what is our experience regarding that? Cases are pending in the courts relating to divorce and restitution of conjugal rights. Even where the Family Courts have been constituted, what is our experience? Our experience, as a lawyer I can say, is that these cases take, at least, three years or four years or five years or 7-10 years to reach a stage of finality. What do you want? Now, from this again the same process will be followed for obtaining a decree of nullity. He may have to undergo a serious kind of procedure, a delayed procedure. ׮־ , since that presumption is there, ֯ ָ it can be decided on the basis of affidavits and within six months. For the last several years, woman organisations in this country, woman movements in this country, have been struggling with this continuing scourge of our society, which is child marriage. Many, many years ago, in 1880s, a letter was punished in the Times of India, which is being quoted in the Standing Committee report. I just want to read it out. We talk about scourge and the impact of that on women. A woman called Rukmabai, a victim of child marriage, wrote to the Times of India on June 26, 1885, "I am one of those unfortunate Hindu women whose hard lot is to suffer the unnameable miseries entailed by the custom of early marriage. This wicked practice of child marriage has destroyed the happiness of my life...." (Contd. by 2J)
