It was not a major disaster. It was a man-made disaster. We in Gujarat always welcome rain. We pray for rain. Rain has not created the problem. It was the mismanagement by the Irrigation Minister who stays in Surat. The Chief Minister has himself admitted and he is now talking of appointing a Commission of Inquiry for early and late release of water from the Ukai Dam, from the Dharoi Dam from where the Surat district, the Anand district, the Kheda district, the Ahmedabad district thousands and thousands of people are marooned, hundreds of people are dead, thousands of animals are dead. The problem of Surat is they are not able to remove the mud, they are not able to remove the bodies of dead animals in the previous flood. The Islamabad datelined report says, "Prior to the Mumbai bom blasts there was a marked progress in the peace process to the extent that New Delhi offered even 'autonomy for Kashmir' through a non-paper to its nuclear rival but Saturday's tit-for-tat expulsions of diplomats by both Pakistan and India proved a serious setback to the already stalled dialogue process" -- the report further says -- "It was days before the Mumbai blasts that Pakistan received a 'non-paper' on Kashmir from India containing the proposal of autonomy to Kashmiri people but within its Constitution." -- it further adds, "The proposal on Kashmir's autonomy calls for the return of the States to its pre-1953 Constitutional position, which means that all its affairs, sans defence, foreign affairs and communications, would be run by the State Government. Sir, the Project Tiger has been under implementation since 1973 as a scheme of the Government of India. Since then, the Project coverage has also increased over the years, from the initial 9 tiger reserves to 28 reserves at present. As many as 17 States are involved in the field implementation of the Project.

The Government of India has taken up this project to promote conservation of tigers, since the significance of its conservation has ramifications beyond State boundaries. Management of forests and wildlife is primarily the responsibility of concerned States. Hence, for the field implementation of the project, States -- which also provide matching grants to recurring items of expenditure-- deploy field staff/officers and give their salaries. The Project Tiger Directorate of the Ministry of Environment and Forests is mandated with the task of providing technical guidance and funding the project.

The Tiger Reserves are faced with ecological disturbances and various other problems. Fragmentation of habitats occur owing to overuse of forest habitats, apart from conflicting land uses leading to loss of habitat. Such overuse of forest resources distorts the forest dynamics thereby affecting the habitat quality to support natural prey base and natal areas for tigers to breed. There are also, in some cases, significant resident population in villages having many cattle which graze in forests leading to their ecological degradation, apart from major sources of regular or intermittent disturbance, such as temples and commercial entities such as tea estates. This also leads to man-animal conflicts, resulting in tiger and prey mortality. (Contd. by PB/1Z)

SHRI A. RAJA (CONTD.): Accordingly, we need to strengthen our efforts for the conservation of the species. Several constraints affect field implementation of tiger conservation activities. The events in the recent past, including, in particular, evidence of large scale poaching, have highlighted the fact that there is a need in the States for greater commitment and vigilance, apart from strengthening the system at Government of India. These concerns can only be effectively addressed by providing statutory authority to the Project Tiger by creating the National Tiger Conservation Authority, apart from the Wildlife Crime Control Bureau, as recommended by the Tiger Task Force appointed by the Prime Minister. The Department-Related Parliamentary Standing Committee on Science and Technology, Environment and Forests, in its 154th Report had also strongly emphasized the creation of the said Bureau as a statutory body under the Wildlife (Protection) Act, 1972.

There is no enabling provision in the Wild Life (Protection) Act, 1972 for constituting a body/authority like Wild Life Crime Control Bureau to take measures for preventing and combating wildlife crimes. Hence, there is a need for providing an enabling provision in the Wildlife (Protection) Act, 1972. These amendments will provide a statutory basis for constituting the "Tiger and Other Endangered Species Crime Control Bureau" (Wildlife Crime control Bureau) by making enabling provisions.

Subsequent to giving the amendment notice relating to the Wild Life (Protection) Amendment Bill, 2005 pending in this House, the Ministry of Environment and Forests had received some suggestions for making some modifications in the pending Bill to remove the apprehensions of the tribal people living in and around of the tiger reserves. Though the provisions contained in the Bill adequately protect such interests, a few changes have been made in some of the provisions of the Bill.

The proposed amendment would address the ecological as well as the administrative concerns for conserving tigers, by creating the National Tiger Conservation Authority, which would provide a statutory basis for protection of tiger reserves, apart from ensuring protection of wildlife through the Wildlife Crime Control Bureau. It would also address the livelihood concerns as well as man-wild animal conflicts in the fringe areas of tiger reserves.
