SHRI MATILAL SARKAR (TRIPURA): Mr. Vice-Chairman, Sir, at the outset, I rise to support the Juvenile Justice (Care and Protection of Children) Amendment Bill, 2006, which has been brought forward by the hon. Minister, Shrimati Renuka Chowdhury.

Sir, by bringing in this Bill, the Government intends to amend the principal Act which was passed in 2000 and which came into force from 2001. Sir, so far as I have been able to understand, there are two categories of children that have found place in this Bill. One category relates to the 'juvenile in conflict with law' and the other category is the 'child in need of care and protection.' In respect of category one, i.e., juvenile in conflict with law, I would like to say that a child is never born as a criminal. When a child is born, he is innocent, he is free from all sorts of sins, as honest as can be. But it is the situation prevailing in society, in some parts of the society which compels a child to commit a crime. So, the term 'juvenile in conflict with law' means an honest, good and sincere boy, who under some compulsion or under some force, has committed something wrong. Sir, the Act should aim at making him a good man, to bring out the good man in him. What is wrong in him has to be undone. That has to be undone.

Sir, in respect of the category 'child in need of care and protection', of course, care and protection are necessary for him, but he should not be treated as an object of charity. The future citizen is hidden in him. It is the right of the child to live here; it is the right of the child to have the pleasures of life. This law must be considered from that point of view.

Sir, coming to the amendments, I support the amendments, but I wish to make a few observations with regard to some of them. Besides institutional rehabilitation, non-institutional rehabilitation has also been included. This is good, and that is why, the definition of adoption has come in. In the definition, it has been said that the child must be permanently separated from his biological parents. Now, this is a legal provision. Legally, he is handed over to the adoptive parents and the adoptive parents become his parents now. But though it has been provided for legally, it cannot be done socially. Parents always remain parents! Therefore, while applying this rule, I urge upon the hon. Minister to see to it that when it is an amicable adoption, when the child is being handed over in accordance with law, this social relation should not be hindered.

Sir, the local authorities have been excluded. This is a good thing, because the Government has come in, district level authorities have come in, and at various levels there are authorities to take care of it. But, even then, the role of local authorities, the Panchayats, Zilla Parishads and the Municipalities cannot be denied; they do have a role to play, in whatever manner it may be. But, if all through, the word, 'local authority' is withdrawn, it looks as if it has no responsibility. It should not go to that extent. The local authorities will always be having some responsibility because they know best about the children; they know best, they know their culture, their background, their family status, etc. Everything is known to the local authorities.

Sir, it has been rightly said that within a period of 24 hours the child should be handed over to the Board. But even 24 hours need not be consumed. It does not mean that the child must be detained for 24 hours. If he can be handed over within two hours, what is the harm? So, if there is any intention to detain him till the next day, he has to be taken care of. Without any logic, he should not be allowed to languish for 24 hours for nothing.

Sir, I must thank the hon. Minister that she has kept the child quite detached from the Police regime. I have gone through the report of the Standing Committee where it has been said that in no case should there be a police lock-up. You have taken this into consideration and I congratulate you that you have made a very important provision here. The child should not be lodged in jail or put in Police custody; he should be better sent to children's homes or special homes. (Contd. by 20/hk)
